Algemene voorwaarden
1. Algemeen
1.1 Deze algemene voorwaarden zijn van toepassing op alle diensten geleverd door Louise Veltkamp Photography, hierna te noemen "de Fotograaf".
1.2 Door gebruik te maken van de diensten van de Fotograaf gaat de klant akkoord met deze algemene voorwaarden.
2. Offertes en Prijzen
2.1 Alle offertes van de Fotograaf zijn vrijblijvend en geldig voor de in de offerte aangegeven periode.
2.2 Prijzen zijn inclusief BTW, tenzij anders vermeld.
2.3 De Fotograaf behoudt zich het recht voor om prijzen te wijzigen. Klanten die reeds een opdracht hebben bevestigd, zullen niet worden getroffen door prijswijzigingen.
3. Auteursrecht en Gebruiksrechten
3.1 Het auteursrecht van alle foto's berust bij de Fotograaf. De Fotograaf blijft te allen tijde eigenaar van de foto’s.
3.2 Het ongeoorloofd gebruik van foto's van de Fotograaf wordt beschouwd als schending van haar auteursrecht. In geval van schending van dit recht, zullen de geldende tarieven van SOFAM door de Fotograaf in rekening worden gebracht.
3.3 De klant verkrijgt het recht om de foto's te gebruiken voor persoonlijke doeleinden. Voor commercieel gebruik is toestemming van de Fotograaf vereist.
3.4 Het is de klant niet toegestaan om zonder schriftelijke toestemming van de Fotograaf de foto's te bewerken, verveelvoudigen of te verspreiden.
4. Betaling
4.1 Betaling dient te geschieden binnen 10 dagen na ontvangst van de factuur, tenzij anders overeengekomen.
4.2 Bij overschrijding van de betalingstermijn is de klant van rechtswege in verzuim, zonder dat hiervoor een ingebrekestelling nodig is. De Fotograaf heeft het recht om de wettelijke rente in rekening te brengen.
5.1 Annulering door Fotograaf
5.1.1 Bij ongunstige weersomstandigheden, zoals storm of hevige regenval, kan een buitenshoot na overleg tussen de Fotograaf en de klant worden geannuleerd. Dit besluit wordt uiterlijk op de ochtend van de geplande fotoshoot genomen. De fotoshoot wordt dan verplaatst naar een nieuwe datum.
5.1.2 In geval van overmacht heeft de Fotograaf het recht de opdracht op te schorten of te annuleren. Onder overmacht wordt verstaan: ziekte, extreme weersomstandigheden, technische storingen, etc. Er wordt zo snel mogelijk een nieuwe afspraak gemaakt.
5.2 Annulering door klant - definitieve boeking
5.2.1 Een boeking is definitief zodra er schriftelijk of digitaal (via e-mail, WhatsApp of boekingssysteem) een datum en tijdstip zijn overeengekomen. Vanaf dat moment houdt de Fotograaf deze tijd exclusief gereserveerd voor de klant.
5.2.2 Annuleren kan tot 14 dagen voor de geplande fotoshoot kosteloos. Bij annulering binnen deze termijn worden de volgende kosten achteraf in rekening gebracht:
- Bij annulering tussen 14 en 7 dagen voor de geplande shoot: 35% van het totale factuurbedrag (basisbedrag van het type shoot).
- Bij annulering tussen 7 dagen en 48 uur voor de geplande shoot: 50% van het totale factuurbedrag (basisbedrag van het type shoot).
- Bij annulering binnen 48 uur voor de geplande shoot, of bij het niet verschijnen (no-show): 100% van het totale factuurbedrag.
5.2.3 Indien er voor de fotoshoot een speciaal tarief, korting of maatwerkprijs is afgesproken, blijven de annuleringspercentages (zoals genoemd in lid 2) gebaseerd op de afgesproken prijs. Het feit dat er een korting is verleend, ontslaat de klant niet van de betalingsverplichting bij een late annulering.
6. Aansprakelijkheid
6.1 De Fotograaf is niet aansprakelijk voor schade ontstaan tijdens de uitvoering van de opdracht, tenzij er sprake is van opzet of grove nalatigheid.
6.2 De aansprakelijkheid zal nooit hoger zijn dan het bedrag dat vermeld staat op de factuur.
7. Oplevering foto’s
7.1 Binnen 14 dagen na de fotoshoot worden de foto's in een digitale galerij geplaatst. Deze foto's zijn uitsluitend bedoeld voor het kiezen van afbeeldingen en mogen onder geen enkele omstandigheid worden gebruikt, gedeeld of gepubliceerd.
8. Naamsvermelding
8.1 Bij het gebruik of publiceren van de foto's door de klant, zoals op sociale media, is het vereist om altijd de naam van de Fotograaf te vermelden of naar haar te verwijzen (op Instagram: @louiseveltkamp.photography).
9. Toepasselijk Recht en Geschillen
9.1 Op deze algemene voorwaarden is het Nederlands recht van toepassing.
9.2 Geschillen zullen worden voorgelegd aan de bevoegde rechter in het arrondissement waar de Fotograaf gevestigd is.
Door het aangaan van een overeenkomst met Louise Veltkamp Photography verklaart de klant zich akkoord met bovenstaande algemene voorwaarden.

1. General
1.1 These general terms and conditions apply to all services provided by Louise Veltkamp Photography, hereinafter referred to as "the Photographer".
1.2 By using the services of the Photographer, the client agrees to these general terms and conditions.
2. Quotations and prices
2.1 All quotations from the Photographer are non-binding and valid for the period indicated in the quotation.
2.2 Prices include VAT unless otherwise stated.
2.3 The Photographer reserves the right to change prices. Customers who have already confirmed an assignment will not be affected by price changes.
3. Copyright and usage rights
3.1 The copyright of all photos belongs to the Photographer. The Photographer always remains the owner of the photos.
3.2 Unauthorized use of the Photographer's photos is considered a violation of her copyright. In the event of a violation of this right, the Photographer will charge the applicable SOFAM rates.
3.3 The client is granted the right to use the photos for personal purposes. For commercial use, permission from the Photographer is required.
3.4 The client is not allowed to edit, reproduce, or distribute the photos without written permission from the Photographer.
4. Payment
4.1 Payment must be made within 10 days of receiving the invoice, unless otherwise agreed.
4.2 If the payment term is exceeded, the client is automatically in default, without the need for a formal notice. The Photographer has the right to charge statutory interest.
5.1 Cancellation by Photographer
5.1.1 In case of unfavorable weather conditions, such as storms or heavy rainfall, an outdoor shoot may be cancelled after consultation between the Photographer and the client. This decision will be made no later than the morning of the scheduled photoshoot, and the photoshoot will be rescheduled for a new date.
5.1.2 In the event of force majeure, the Photographer has the right to suspend or cancel the assignment. Force majeure includes illness, extreme weather conditions, technical malfunctions, etc. A new appointment will be made as soon as possible.
5.1.3 Changes to the assignment by the client must be communicated in a timely and written manner and may lead to a price adjustment.
5.2 Cancellation by the Client - Definitive Booking
5.2.1 A booking becomes definitive once a date and time have been agreed upon in writing or digitally (via email, WhatsApp, or the booking system). From that moment on, the Photographer keeps this time exclusively reserved for the client.
5.2.2 Cancellation is free of charge up to 14 days prior to the scheduled photoshoot. In the event of a cancellation within this period, the following costs will be charged retrospectively:
- Cancellation between 14 and 7 days before the scheduled shoot: 35% of the total invoice amount (base amount of the respective shoot type).
- Cancellation between 7 days and 48 hours before the scheduled shoot: 50% of the total invoice amount (base amount of the respective shoot type).
- Cancellation within 48 hours of the scheduled shoot, or in the event of a no-show: 100% of the total invoice amount.
5.2.3 If a special rate, discount, or custom price has been agreed upon for the photoshoot, the cancellation percentages (as mentioned in section 5.2.2) will remain based on the agreed price. The fact that a discount was granted does not exempt the client from their payment obligation in the event of a late cancellation.
6. Liability
6.1 The Photographer is not liable for damage occurring during the execution of the assignment unless there is intent or gross negligence.
6.2 Liability will never exceed the amount stated on the invoice.
7. Delivery of photos
7.1 Within 14 days after the photoshoot, the photos will be placed in an online gallery. These photos are exclusively for selecting images and must not be used, shared, or published under any circumstances.
8. Attribution
8.1 When using or publishing the photos, such as on social media, the client is required to always mention the name of the Photographer or refer to her (on Instagram: @louiseveltkamp.photography).
9. Applicable Law and Disputes
9.1 Dutch law applies to these general terms and conditions.
9.2 Disputes will be submitted to the competent court in the district where the Photographer is located.
By entering into an agreement with Louise Veltkamp Photography, the client declares agreement with the above general terms and conditions.
